Toronto, Canada Workplace Safety and Insurance Board Full time

As a lead investigator, coordinate and conduct complex/sensitive investigations into allegations of fraud-related activities which directly affect the operational and financial interests of the Workplace Safety & Insurance Board. Investigate offences against the Workplace Safety & Insurance Act and/or the Criminal Code of Canada. Manage the use of externally contracted investigative resources. Prepare court briefs, informations, summonses, search warrants and other court documents. Lead and direct Search Teams in specific investigations. Manage evidence and facilitate relevant Motion Hearings including by drafting court documents and appearing on behalf of the Board. Commence proceedings by laying an information under the Provincial Offences Act and serving summonses to accused persons and witnesses. Participate and assist in the prosecutorial process before the Courts. Provide advice and make recommendations relating to matters that arise during the course of an investigation. Provide law enforcement expertise and guidance.

**Major Duties & Responsibilities**

1. Plan, coordinate and conduct investigations of WSIB Stakeholder fraud and non-compliance that are sensitive and confidential. Conduct an initial review of the referral information to determine what specific investigative activities, tools and techniques are required, and develop an investigation action plan for commencing an investigation.

2. Utilize externally contracted investigative resources. Assign components of the investigation to the appropriate resources. Monitor and provide guidance. Ensure expected standards and contractual obligations are met. Evaluate the vendor’s performance and reviews invoices to ensure accuracy. Assess the results and incorporate into ongoing investigation plan.

3. Conduct interviews and obtain statements (audio and/or video) from witnesses that may include workers, employers, health care providers, representatives/lawyers, WSIB staff, police or other regulatory agencies. Conduct and obtain cautioned statements from accused individuals.

4. Analyze evidence and other information to determine the best course of action, such as the laying of charge(s). Complex investigations may require innovative investigative techniques or the reinterpretation of existing investigative approaches. Prepare and present reports containing investigative results to assist WSIB operational areas in administrative decision making.

6. Plan for searches and secure the necessary resources internally and externally from other agencies as required. Prepare and conduct pre-search briefings. Lead the execution of judicially authorized search warrants, coordinating and directing all search personnel including police, other investigators, and Information Technology staff. Communicate with management at the site being searched, ensuring explanation and articulation of the execution. Respond to requests from counsel or third parties as required. When acting As a Search Team Leader in specific investigations, maintain integrity of search by ensuring scene control, considering the needs of the business or residence.

8. Where sufficient evidence has been obtained to provide reasonable grounds, lay charges against WSIB stakeholders. Subject to requirements of particular courts, appear in person for the purpose of laying informations or provide affidavit and or forms as required by regulation. Serve summons in person or electronically as required considering unique challenges posed by unpredictable circumstances.

10. Provide advice, support and education to assist WSIB staff, court staff and the public in understanding the offence provisions in the Workplace Safety and Insurance Act and the WSIB Operational Policies governing offences and penalties.

11. Maintain working relationships with law enforcement agencies and government institutions to facilitate joint investigations and to exchange information on various types of fraud-related activities and wrongdoing.

12. Provide law enforcement expertise to WSIB business partners while assigned to specialized investigative teams. In the absence of policy/procedure, develop original and unique approaches to examining data and determining investigation direction.

13. Perform other related duties as assigned or required

**Job Requirements**

Education
- University completion at undergraduate level with a Certificate of Basic Constable Training. Valid Ontario G class driver's license.

Experience
- Ten years prior experience in law enforcement and conducting investigations.
