Duties

1. Delivers the regulatory enforcement program necessary for the safe conduct of the transportation operations and activities within the Region.

2. Exercises Ministerial delegation of authority under Transport Canadas Safety and Security Acts and takes appropriate action in instances of non-compliance.

3. Investigates / leads the investigation of complaints against individuals, enterprises and organizations, and alleged violations against Acts and related regulatory instruments; prepares the final investigation case reports; and recommends appropriate punitive / non-punitive action.

4. Support the preparation and presentation of cases before the Transportation Appeal Tribunal of Canada (TATC) and provide testimony as the lead investigator.

5. Provides input to regulatory and policy changes for incorporation into the DeskBook and other related guidance materials.

6. As a subject matter expert in investigative and enforcement work, and as part of a multi-disciplinary team, provide advice, interpretation, and guidance to internal and external stakeholders; participates in various internal /external meetings and committees; and provides briefings to modal program or modal inspectorate.

7. Identifies cross-functional issues of interest to other internal and external stakeholders and engages or recommends the engagement of subject matter experts from a variety of disciplines regionally, nationally, and internationally, while delivering the Enforcement Program.

8. Integrates, promotes, and supports governmental, departmental key priorities, commitments and initiatives across the organization.

Work environment

A hybrid work policy is currently in place at Transport Canada. The position to be staffed is located at Yonge Street in Toronto. The successful candidate will be required to work on-site at a minimum 40% of their working hours.

Intent of the process

The purpose of this selection process is to staff two positions on an indeterminate basis. A pool of partially and/or fully qualified candidates may be established within Transport Canada and may be used to staff similar positions with various tenures (including indeterminate, term, assignment, secondment, acting, deployment).

Education:
A degree or a diploma from a recognized post-secondary institution or an acceptable combination of education, training, or relevant experience.

Experience:
Significant work experience* conducting complex**administrative or penal investigations.

* Significant work experience is considered to be at least three years.

**Complex: when several factors exist which make the investigation difficult due to the need to coordinate multiple lines of inquiry and/or the requirement to implement a structured set of steps and processes to complete the task.

Experience in conducting interviews, evidence-gathering and writing documents such as investigative reports, case briefings, and/or court documents.

Experience in interpreting and applying legislation or regulations.

Candidates can expect a hybrid work model following Treasury Board Secretariat guidelines. The new Government of Canada requirement to work at a designated worksite at least two to three times per week, or 40% of the regular schedule, is consistent with our hybrid approach and flexibility. At the time of hiring, a work arrangement will be put in place, which may be modified over time based on various considerations such as operational requirements.
